Terms & Conditions

Content Cloud is operated by Capturing Investments (Pty) Ltd ("Content Cloud", "we", "us"). By creating an account or continuing to use the service you agree to these terms, and you confirm that you are of legal age and, where you sign up for an organisation, that you have authority to bind it.

The service

Content Cloud lets photographers and videographers upload finished work and deliver it to their clients through branded online galleries. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected. You may not reverse engineer the service, resell or redistribute it, or circumvent its technical limits.

Your account

You must give accurate account information and keep it up to date. You are responsible for keeping your credentials confidential and for everything that happens under your account.

Your content

You keep ownership of the photos, videos and other material you upload. You grant us a limited licence to store, process and display that material solely to provide the service to you and the clients you share galleries with. You confirm you hold the rights needed to upload it and to let your clients view and download it. If a rights-holder contacts us about material on the service, we may remove it; repeated infringement may end your account.

Acceptable use

  • No unlawful use, fraud or spam.
  • No infringement of anyone else's intellectual property or privacy.
  • No interference with the security of the service — no malware, probing, or scraping.

Our intellectual property

We retain ownership of the service itself, including its software, documentation and branding. Nothing in these terms transfers that to you.

Availability

We work to keep Content Cloud running well, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Payment and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Paid plans renew monthly until cancelled. You can cancel at any time from the Billing page; access continues until the end of the period you have paid for, after which your studio moves to the free Starter plan and galleries beyond that plan's limits are unpublished.

Suspension and termination

We may suspend or end access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. When your account ends you will have a reasonable window to export your material, after which it may be deleted.

Liability

To the extent permitted by law, our aggregate liability is capped at the fees you paid in the twelve months before the claim, and we exclude indirect, consequential and special damages including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, unlawful use, or breach of these terms.

General

These terms are governed by the laws of South Africa, and the South African courts have jurisdiction. You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
